The Swedish Supreme Court in judgement regarding the usage of trade marks
Swedish Supreme Court, Högsta domstolen (HD), has in a recent decision (9 July 2014) tried the usage of another company’s trade mark in promotion material. The company Mon.zon published a picture in their product catalog containing a competing company’s (Layher) products without prior consent. HD did not consider that there was a risk for confusion regarding the different companies’ trade marks’ function of indicating origin and the usage was therefore regarded permitted.
