Dispute Resolution – Litigation and Out of Court Disputes

We represent clients in all kinds of disputes – in court and out of court. We assist in writing and responding to cease-and-desist letters, represent clients in settlement negotiations, prepare court submissions and represent clients in court hearings.

Assessment of Protectability

We make assessments of whether or not it is possible to protect a design, text, trademark, illustration, slogan etc. as an intellectual property right.

Infringement Analysis

We make assessments of whether someone infringes the client’s protected work, trademark, design etc. – or if the client has come too close to a competitor’s trademark, design, text etc. and is at risk of committing an infringement.

Assessment of Advertising

We make assessments of whether advertising is legal or unlawful – does it constitute free-riding on someone else’s goodwill (passing off), is it misleading…?

Preparation – Review of Agreements

We prepare and review agreements on licensing, purchase and sale of intellectual property rights – both in connection with business transfers and as separate regulations.
